We advise on all aspects of competition law, including:
- advising on the Commerce Act risk of proposed mergers and acquisitions, including working with counsel based in other jurisdictions on cross-border mergers and acquisitions;
- representing clients on applications for merger clearance or advising on a strategy for engagement with the Commerce Commission if clearance is not sought;
- advising on cartel conduct, collaborative activities and anti-competitive agreements, including reviewing pricing and other business practices;
- advising businesses with substantial market power on their interactions with customers, suppliers and competitors;
- assisting clients to respond to information requests and ‘please explain’ letters received from the Commerce Commission and responding to Commerce Commission investigations;
- preparing and advising on Communications Protocols to govern the relationship between competitors and the extent to which they can jointly act and share information in respect of collaborative activities;
- making applications for cartel leniency and immunity; and
- providing tailored Commerce Act training sessions and compliance materials.
